Please read these Terms and Conditions ("Terms") carefully before using the Job Alerts - Gemheap Telegram bot service (the "Service") operated by Gemheap ("us", "we", or "our").
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. By starting the bot or subscribing to a paid plan, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access or use the Service.
1. Description of Service
Job Alerts - Gemheap is a Telegram bot that monitors publicly available job boards (Greenhouse, Lever, Ashby, and Personio) and sends you Telegram notifications when a watched company posts a new opening. The Service is provided on a subscription basis with a free tier and paid plans.
We reserve the right to modify, suspend, or discontinue the Service (or any part of it) with or without notice at any time. We will endeavour to give reasonable advance notice for material changes.
2. Eligibility
You must be at least 18 years of age and have the legal authority to enter into a binding contract to use the Service, including any paid plans. By using the Service, you represent and warrant that you meet these requirements.
3. Subscription Plans and Payment
- Free plan: Monitor up to 3 companies at no cost. No payment information is required.
- Pro plan: Monitor up to 25 companies for $9 per month.
- Team plan: Monitor up to 100 companies for $29 per month.
Merchant of Record. All paid transactions are processed by Paddle (Paddle.com Market Limited / Paddle Payments Ltd. / Paddle.com Inc., depending on your location) acting as the Merchant of Record. When you upgrade to a paid plan, you purchase the Service from Paddle, who then makes it available to you under these Terms. Paddle's own Buyer Terms also apply to your transaction.
Automatic renewal. Paid subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date.
Price changes. We reserve the right to change plan prices at any time. You will be notified of any price change and your continued use of the Service after the change takes effect constitutes your agreement to pay the updated amount.
4. Cancellation
You may cancel your paid subscription at any time by sending the /cancel command to the bot or by contacting us at rm.gemheap@gmail.com. Cancellation takes effect immediately: your plan is downgraded to Free and no further charges are made. Please refer to our Refund Policy for information on refunds.
5. Acceptable Use
You agree not to use the Service:
- For any illegal or unauthorised purpose.
- To attempt to circumvent plan limits through automated means or multiple accounts.
- To scrape, republish, or resell job data obtained through the Service without permission.
- To attempt to gain unauthorised access to the Service or its underlying infrastructure.
We reserve the right to suspend or terminate access for any user who violates these rules.
6. Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of Gemheap and its licensors. The Service is protected by copyright, trademark, and other applicable laws. Our trademarks may not be used in connection with any product or service without the prior written consent of Gemheap.
Job data surfaced by the Service is sourced from publicly available third-party job boards. We make no claim of ownership over that data.
7. Termination
We may terminate or suspend your access to the Service immediately, without prior notice or liability, if you breach these Terms. Upon termination, your right to use the Service will cease immediately. If you wish to stop using the Service, you may simply discontinue using the bot and cancel any paid subscription.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. GEMHEAP DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT JOB ALERTS WILL BE DELIVERED IN REAL TIME IN ALL CIRCUMSTANCES. JOB DATA IS SOURCED FROM THIRD-PARTY JOB BOARDS AND WE CANNOT GUARANTEE ITS ACCURACY OR COMPLETENESS.
9. Limitation of Liability
IN NO EVENT SHALL GEMHEAP, ITS DIRECTORS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF YOUR USE OF OR INABILITY TO USE THE SERVICE. OUR TOTAL AGGREGATE LIABILITY TO YOU SHALL NOT EXCEED THE TOTAL FEES YOU PAID TO US IN THE THREE MONTHS PRECEDING THE CLAIM.
Nothing in these Terms limits or excludes liability that cannot be excluded under applicable mandatory consumer law.
10. Indemnification
You agree to defend, indemnify, and hold harmless Gemheap and its officers, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or expenses arising from your use of the Service or your breach of these Terms.
11. Governing Law
These Terms shall be governed and construed in accordance with the laws of Moldova, without regard to its conflict of law provisions. Nothing in this clause affects any mandatory consumer rights you may have under the laws of your country of residence.
12. Changes to Terms
We reserve the right to modify these Terms at any time. If a revision is material, we will endeavour to provide at least 14 days' notice before the new terms take effect. By continuing to access or use the Service after revisions become effective, you agree to be bound by the updated terms.
